Terms and conditions
This English text is for convenience only. The Dutch version is legally authoritative. Algemene voorwaarden
In brief
- Work starts after written quote acceptance and a deposit of 35% of the agreed fee.
- Free cancellation or rescheduling is possible until 4 calendar days before the session; later rules apply in article 6.
- We keep session files for 18 months; mixing and mastering include 2 revision rounds unless agreed otherwise.
- Dutch law applies; mandatory consumer rights remain unaffected.
1. Scope and identity
These terms apply to all services of Monogamyvault B.V. (the studio), Elandsgracht 84, 1016 TX Amsterdam, KvK 92797452, VAT NL842249497B01. Contact: 020 623 8147 and [email protected].
The studio trades as Monogamyvault in Amsterdam, offering vocal recording, mixing, mastering, podcast recording and live room for bands. Company details are in legal notice.
These terms apply together with each written quote. If they conflict, the quote prevails except where mandatory consumer law says otherwise. Only the Dutch version is legally binding; this English text is provided for convenience.
2. Definitions
- Client
- The natural person or legal entity accepting a quote.
- Consumer
- A natural person acting outside their trade, business or profession.
- Business client
- A client acting in the course of a profession or business.
- Quote
- A written proposal describing the service, date, VAT-inclusive price, deposit and any special terms.
- Session
- A reserved time slot in the studio or an agreed period for offline work (mix/master).
- Files
- Recordings, session projects, mixes, masters and delivered exports.
3. Quotes, confirmation and contract formation
Requests via contact, phone or email lead to a quote. We aim to respond within 2 business days. A quote stays valid for twice that period in calendar days unless another deadline is stated.
The contract is formed when the client accepts the quote in writing (email is enough) and the deposit reaches our account. Until then, a time slot is non-binding. We may decline requests for safety reasons, unrealistic scheduling or legal conflicts.
For distance contracts we confirm essential details by email. Information on services and service pages is not a binding offer without a quote.
4. Prices, VAT and on-site guides
Quote and website prices are in euros, including 21% VAT, unless marked ex-VAT for business clients. The accepted quote amount controls.
Guide rates on the site (including €105 per vocal hour, €210 per mix track, €85 per master track, €268 per podcast episode, €218 for a four-hour live block) may change; open quotes stay fixed within their validity.
Extra hours during a session are billed only after you agree, at the quote rate or the relevant hourly service rate. Travel, parking or permits are excluded unless stated upfront.
5. Deposit, invoicing and payment
When confirming a session or project we request a deposit of 35% of the total agreed fee including VAT. The deposit offsets the final invoice.
The balance is due on the session day for consumers unless the quote says otherwise. Business clients pay within 21 days of invoice date when agreed in writing.
Payment by bank transfer; card payment in the studio when announced. Late payment may incur statutory commercial interest and reasonable collection costs for business clients. Until full payment we may withhold final masters; working files follow the archive rules in article 9.
6. Cancellation, rescheduling and no-show
| Timing | Effect |
|---|---|
| More than 4 calendar days before the session | Free cancellation or one reschedule; deposit refunded within 14 days if you cancel. |
| 4 days or less before the session | Deposit retained unless we rebook the slot; then we refund proportionally. |
| Failure to attend without notice | Full session fee due, minus deposit already paid. |
Send requests in time to [email protected]. Consumer withdrawal rules remain where applicable; see article 7.
7. Consumer withdrawal
If a consumer concludes a distance contract (email, phone, form), a 14-day withdrawal period generally applies from contract conclusion under Dutch distance-selling rules.
For services on a fixed date or period (studio booking), withdrawal may lapse if performance starts at your request before the period ends and you explicitly agreed. For fully performed services after your prior consent, withdrawal also lapses.
To withdraw, send a clear statement to [email protected]. We refund within 14 days using the same payment method unless agreed otherwise. For partial delivery, a proportionate amount may be charged for work already done.
8. Sessions, house rules and safety
Studio hours: Monday–Friday 09:30–18:30, Saturday 12:00–17:00, Sunday closed.. The live room suits up to 6 musicians at once; podcast tables seat up to 4 guests. No smoking or vaping in technical areas.
Participants under 16 need written consent from a parent or guardian who confirms the booking and stays present. Everyone follows engineer instructions for safety and hearing protection; we keep monitor levels moderate.
Damage to studio equipment caused wilfully or by gross negligence by the client or guests is charged to the client. Your own gear stays at your risk; insurance is recommended.
9. Delivery, archive and revisions
Unless stated otherwise we deliver WAV or other formats agreed in the quote. Online mix/master work starts once complete, usable source files arrive; timelines run in business days from that point.
We keep session and project copies for 18 months after the last relevant activity, then delete them unless extension is agreed in writing. Download and backup are your responsibility within that window.
Mixing and mastering include 2 revision rounds by default: one bundled feedback list per round. Extra rounds or a new artistic direction after approval are quoted separately. Practical tips: delivering stems and loudness for streaming.
10. Intellectual property and rights
Music, lyrics, samples and other material you supply remain yours or the rights holders’. You warrant necessary rights and handle collective management where required.
We do not claim copyright on raw recordings made for you. Producer rights on phonograms may arise by law; for recordings you fully fund and initiate, we acknowledge you intend to keep economic rights once the invoice is paid. Commercial exploitation without third-party licences remains your duty.
We do not use your recordings to train AI models and do not create voice clones without written consent. We publish your name or project as a reference only with your approval.
11. Liability
We perform work to professional standards in our field. Artistic taste, performer quality and commercial success are not guaranteed. Our liability is limited to direct damage from attributable breach, capped at the invoice for that job, except for intent, recklessness or personal injury.
Indirect loss, lost profit or data loss from late backup is excluded where law allows. The disclaimer on website information applies alongside this clause for online content.
12. Personal data
We process personal data under the privacy policy. The contact form uses FormSubmit with transfer to the United States; see legal notice on the form and the data processing agreement for business scenarios.

13. Force majeure
In force majeure — power failure, fire, pandemic, government measure or critical supplier outage — our obligations suspend without damages. We inform you promptly and offer a new date. If force majeure lasts more than 60 days, either party may terminate; amounts for unperformed services are refunded.
14. Complaints, disputes and governing law
Report complaints about a session or delivery within 14 days via [email protected], with a short description and relevant file names. We respond within 2 business days with a proposal.
Consumers may bring disputes before the competent court in the district where Monogamyvault B.V. is established, without prejudice to statutory out-of-court options where available. We do not appoint a specific consumer mediator not named in our documents.
Dutch law governs these terms. The UN Convention on Contracts for the International Sale of Goods is excluded for business contracts where parties so intend.
